The Complaint of the above named plaintiff respectively shows to this court upon information and belief that William L. Parmalee now decd formly [sic] of Marlbogh [sic] Ulster Co. State of New York for the purpose of securing the payment to John Rusk of the sum of Five Hundred and Sixty dollars with interest thereon, on or about the 18th day of August one thousand eight hundred and ninety one executed and delivered to John Rusk a bond bearing date on that day, sealed with his seal whereby the said William L. Parmalee did bind his heirs, executors and administrators in the penalty of Eleven Hundred and Twenty Dollars upon condition that the same should be void if the said William L. Parmalee or his heirs, executors and administrators should pay to the said John Rusk or his executors, administrators or assigns the said sum of money first above mentioned, as follows: the full sum of Five Hundred and Sixty Dollars on the 18th day of August eighteen hundred and Ninety two with interest thereon to be computed from August 18, 1891 at the rate of six per cent [sic] per annum and to be paid Annually on the 18th day of August in each year and, as collateral for the payment of the said indebtedness, the said William L. Parmalee on the same day executed, duly acknowledged and delivered to the same John Rusk a mortgage, whereby he granted, bargained and sold to the said John Rusk the following described premises, with the appurtenances thereto, that is to say,

All that certain lot, piece or parcel of land situate lying and being in the village and town of Marlborough Ulster Co. N.Y. Bound and described as follows to wit:

Beginning at a point in the intersection of Western Avenue and West Street and lands of Anne Emogene Merritt Ninety four feet along west Side of West Street to the Northwest corner of lands hereby intended to be conveyed. From there and in line with West Street in a Southeasterly direction Sixty feet to lands of Dewitt W. Kniffen. From there in a westerly direction along the north line of land of Said Kniffen One Hundred and twenty feet to lands of Harry M. Winslow. From there in a Northerly direction along the east side of lands of Said Winslow and Josephine Milden Sixty feet to lands of said Anne Emogene Merritt. From there in an easterly direction along the south line of said Merritts [sic] land one hundred and twenty feet to the place of beginning. Said lot being sixty feet front and rear by one hundred and twenty feet deep and being same premises Mentioned in deed of Conveyance to Anne Emogene Merritt and which is reserved therefrom (therefore?) Dolce March 27 1886 [?]

The said mortgage containing the same condition as the said Bond, and the further condition that if the said mortgagor should not pay the moneys thereby secured according to the terms thereof, then the said John Rusk his heirs, executors, administrators or assigns were empowered to sell the said mortgaged premises......

And the plaintiff further show that the said mortgage was duly recorded in the office of the clerk of the County of Ulster on the 19th day of August [1891] .... Book No. 208 of Mortgages, page 449, at 1-50 o'clock p.m.

... the defendant has failed to comply ... by omitting to pay the sum of Five Hundred and Sixty Dollars with the interest thereon which ... became due on August 18, 1892....2
